1. Acceptance of Terms
By signing up for or using After Relay ("Service"), you agree to these Terms of Service ("Terms"). If you are accepting on behalf of a funeral home or other organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, do not use the Service.
2. Description of Service
After Relay is a B2B software-as-a-service platform that enables funeral homes to manage aftercare programs for the families they serve. Features include case management, scheduled outreach messaging, family portal access, and reporting tools.
The Service has two distinct user types: funeral home staff (the paying customer) and family members (end users who access a read-only portal at the invitation of the funeral home). These Terms apply to both, though billing obligations apply only to funeral homes.
3. User Accounts
Funeral homes are responsible for all activity that occurs under their account, including actions taken by staff members they invite. You must keep your credentials secure and notify us immediately at support@afterrelay.com if you suspect unauthorized access.
You must provide accurate account information and keep it current. Accounts are non-transferable without our written consent.
4. Acceptable Use
You agree to use the Service only for lawful purposes consistent with its intended use. You may not:
- Enter false or fraudulent family information
- Send unsolicited, deceptive, or harassing messages to families through the platform
- Use the Service to violate any applicable privacy law, including laws governing the handling of sensitive personal data
- Attempt to access data belonging to other funeral home accounts
- Reverse-engineer, copy, or resell any part of the Service
- Use automated scripts to scrape or extract data from the platform
We reserve the right to suspend accounts that violate these rules. Given the sensitive nature of the data involved, we take these obligations seriously.
5. Privacy
Our Privacy Policy is incorporated into these Terms by reference. By using the Service, you agree to the collection and use of information as described there. Funeral homes using After Relay act as data controllers for the family information they enter; After Relay acts as a data processor on their behalf.
6. Intellectual Property
After Relay retains all rights to the platform, its design, codebase, and proprietary features. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription.
You retain ownership of the data you enter into the platform (case records, family contact information, and uploaded files). You grant us a license to store and process that data solely to provide the Service.
7. Disclaimers
The Service is provided "as is" and "as available." We make no warranties, express or implied, that the Service will be uninterrupted, error-free, or meet every specific requirement of your business.
After Relay is a communications and case management tool. It is not a substitute for professional grief counseling or mental health services. If a family member is in crisis, please direct them to a qualified professional or emergency services.
8. Limitation of Liability
To the maximum extent permitted by law, After Relay's total liability to you for any claim arising from the Service shall not exceed the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or data, even if we have been advised of the possibility of such damages.
9. Governing Law
These Terms are governed by the laws of the United States. Any disputes arising from the Service will be resolved through binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property or data security matters.

We may update these Terms from time to time. Material changes will be communicated to account holders by email at least 14 days before taking effect.
